Uninsured Motorist Coverage

Uninsured Motorist Coverage

car-accidentIn Arkansas, insurance companies must offer “Uninsured Motorist Coverage,” which the insured may reject in writing. Ark. Code Ann. §23-89-403 (2015). The fact that the Arkansas Legislature has made it the law that insurance companies must offer this coverage should tell us just how important it is to have the coverage.  The Legislature also requires a signed rejection of the coverage, verifying that the coverage was offered and rejected, in order to protect the insurance company.  Any agent who suggests that you should sign a rejection of Uninsured Motorist Coverage does not have your best interests in mind, and should not be trusted.  Everyone needs this coverage, and again, the Legislature thought it was so important that they require all insurance companies to offer the coverage. Uninsured Motorist Coverage protects you if you are in a car wreck with a driver who does not carry car insurance and that driver is deemed to be at fault in the accident.

Why is Uninsured Motorist coverage important?

Uninsured Motorist coverage is essential because there are so many drivers on the roads today that don’t have insurance, and this coverage gives us some protection. It is important to protect yourself, and your loved ones, from the financial loss of suffering a personal injury in a car wreck with an uninsured motorist. Since uninsured motorists rarely have any assets to take if you sue them, taking precautionary measures such as purchasing Uninsured Motorist Coverage, will help you avoid a potentially catastrophic financial loss.

After an accident, if you suspect the driver who hit you is uninsured, you should file an uninsured claim against your insurance company as soon as possible. Signs that a driver does not have insurance are if the driver refuses to give you his or her insurance information, or, notifies you that he or she doesn’t have car insurance. Deadlines for filing an uninsured claim can be relatively short and insurance companies will try to pay out the minimum amount in damages listed in the police report.

Hiring an experienced attorney will help you in obtaining the best outcome possible resulting from a car wreck. Whether you need an experienced attorney to investigate the opposing party’s assets in case you sue them directly, or, if you need an attorney to make sure you are not influenced to settle your claim for less than the total amount you are owed by your insurance company, we are here to help.
